European Union adopts a new framework for the transfer of personal data to the USA

On July 10, 2023, the European Commission adopted its adequacy decision for the EU-U.S. Data Privacy Framework. This decision concludes that the USA ensures an adequate level of protection – comparable to that of the European Union – for personal data transferred from the European Union to US companies under the new Framework. As such, personal data can henceforth flow safely from the European Union to US companies adhering to the new Framework, without having to put in place additional data protection safeguards.

French State ordered to compensate victims of air pollution for the first time

In two judgments handed down on June 16, 2023, the Paris Administrative Court recognized for the first time the existence of a causal link between the bronchiolitis and ear infections affecting two children and the French State’s failure to take action in terms of air pollution. These two judgments have been issued in a context marked by increased sanctions against the French State in environmental matters.

The new social regime for the mutual termination indemnity took effect on September 1, 2023

Since September 1, 2023, a new social regime applies to the mutual termination indemnity. The mutual termination indemnity is no longer subject to the 20% flat-rate contribution but to a single contribution of 30%.

Third session of our Compliance Task Force - ESG Compliance: Is your company ready?
The third session of the new Compliance Task Force created by the European American Chamber of Commerce Auvergne Rhone-Alps (EACC) in partnership with Soulier Avocats will be held on October 5, 2023. This session will bring together experts from the Digital Transformation and Compliance Task Forces to offer a comprehensive look at the new CSR regulations and their impact on companies. Through a study of the Corporate Sustainability Reporting Directive (CSRD) that will come into force in 2025, these experts will analyze the extent to which digital tools can facilitate automated data collection, documentation management and analysis, as well as data communication, and how digital is likely to be a factor contributing to better compliance and sustainable performance. Alongside experts from Deloitte and Aras (a company specialized in the development and publishing of product development software), our Counsel Claire Filliatre, Esq., Member of the Compliance Committee of the Lyon Bar and Chair of the “Private Business Ethics” sub-committee of the Compliance Committee, will provide an overview of the regulatory framework, present the new standards and obligations applicable to enhanced ESG reporting, and emphasize the need to make businesses more aware of their responsibilities with regard to social and environmental matters.

WLG | impact '23: Local steps to global impact
As part of the annual network-wide Corporate Social Responsibility initiative called WLG ׀ impact ‘23 promoted by the World Law Group, a network of 61 leading independent law firms with offices in major commercial centers worldwide to which our Firm belongs, we partnered with the soccer division of the multi-sports club called Rhodia-Vaise Club which has its head office in the 9th District of Lyon to host a cleaning session. As such, on July 3, members of Soulier Avocats went on the Club’s site and joined Jean-Jacques, the Chair of the soccer division, and some young soccer players. Our mission: Removing, collecting, and sorting all kinds of garbage, trash and waste, including cigarette butts, food packaging, food scraps, straws and coffee sticks, plastic bottles and caps, lids and other plastic utensils, glass bottles, cans, bottle caps, etc.
