Global warming (“Case of the century”): The French State must repair the ecological damage before December 31, 2022

For the first time, on October 14, 2021, the Paris Administrative Court ordered the French State to repair the consequences of its failure to combat climate change.

The Court ordered that the overrun of the greenhouse gas emissions cap set by the first carbon budget (2015-2018) be compensated by December 31, 2022 at the latest.

The new legal guarantee of conformity for digital contents and services

Ordinance No. 2021-1247 published on September 29, 2021 transposes into French consumer law European Directives (EU) 2019/770 and (EU) 2019/771 of May 20, 2019 and introduces a new legal guarantee of conformity specific to digital contents and services.

The new provisions will apply as from January 1, 2022.

Mismanagement by a manager who did not prompt the regularization of the shareholders' equity: Further clarification from the French Supreme Court

The liability of the manager of a company placed in judicial liquidation is often sought on the basis of Article L. 651-2 of the French Commercial Code which allows the court, in the event of mismanagement having contributed to the company’s shortfall of assets, to decide that the amount of this shortfall shall be borne, in whole or in part, by said manager.

In a decision issued on September 8, 2021, the Cour de Cassation (French Supreme Court) has clarified the application of this Article to a manager who did not convene the shareholders to regularize the situation of the company, the shareholders’ equity of which had fallen below half of the share capital.

WLG ׀ impact: Our contribution to this global CSR initiative

As part of the first network-wide Corporate Social Responsibility initiative called WLG ׀ impact organized by the World Law Group, a network of 61 leading independent law firms with more than 400 offices in major commercial centers worldwide to which our Firm belongs, we decided to work with a local association called Nettoyons Lyon (literally Let’s clean up Lyon) to work on a river cleaning session.

On October 8, 2021, part of our team joined up three members of the association at a spot by the Rhône River near our Lyon office.

After a 30-minute brief on how the different types of waste we all produce impact the environment, we received safety instructions and then got to work.

Our objective was to remove underwater waste and polluting objects using big neodymium magnets and grapples!

2021 edition of the Night of the Law: Joint dialogue on criminal justice

On October 4, the Faculty of Law of the University Jean Moulin Lyon III participated in the 2021 edition of the Night of Law.

Various debates and conferences were held under the authority of the Dean of Lyon III, University Professor Hervé de Gaudemar, on the campus of the Manufacture des Tabacs in Lyon.
