Organizing the management of their subsidiaries in France is a major concern for both French and foreign corporate groups. Appointing senior executives to positions such as president or managing director partially addresses this issue. However, it does not always meet the challenges of day-to-day management, especially when the designated legal representative is distant from the place of operations. This is why delegations of authority are increasingly used. Unfair competition: Classification of prohibited practices

In France, freedom of trade and industry is long-standing principle, first proclaimed after the French Revolution by the so-called Allarde Decree of March 2 and 17, 1791. This fundamental principle, that was given constitutional value by the French Constitutional Council in a decision dated January 16, 1982, has one key exception: Unfair competition. Unfair competition practices are not exhaustively listed in French legislation; instead, they are identified on a case-by-case basis by French courts. However, they can be grouped into four main categories.

European Commission establishes AI Office to strengthen EU leadership in trustworthy Artificial Intelligence

On May 29, 2024, the European Commission unveiled the Artificial Intelligence Office aimed at “enabling the future development, deployment and use of AI in a way that fosters societal and economic benefits and innovation, while mitigating risks”. This new Office will play a key role in implementing the European Artificial Intelligence Act, strengthen the development and use of safe and trustworthy artificial intelligence, and positioning the European Union as a leader in international discussions.
